I started my day looking at the calendar and seeing that it was the 13th, a Monday. Shouldn’t be unlucky, that is reserved for Friday the 13th, not Monday. So off to work I went. A Five Star Driver for Uber.

One careless moment by VIA Officer Clyde Bankston changed my life forever.

VIA – The Destroyer of Worlds!

This event occurred on June 13th, 2022, and it will be my third Christmas without a resolution.  VIA has done nothing to make this right. I’ve hired a law firm,  and my lawyers tell me that VIA is drawing it out and delaying, no settlement and this is normal because VIA has nothing to gain by settling. Even though they are 100% at fault as seen in the dashcam video.

The accident destroyed my health physically, mentally, and financially and sent me down a lonely path of X-rays & MRI, pain management, chiropractic treatment, and traumatic brain injury treatment and therapy. With my car totaled and the insurance from Uber, Progressive only paid $11,000. on a 2016 Nissan Altima I had just bought for $16,000. putting me in the hole for $5,000. just on my car, now on my credit report, nobody will give me a loan. On top of everything I am now $116,000.00 dollars in debt for past medical bills.

It took me over 9 months to get walking again without a cane. All that time in treatment and therapy I was unable to work, I fell behind on 9 months of rent, and past utilities I’m still struggling to get taken care of and pay off. I’ve had to borrow high-interest loans in the first months afterward just to have food for me and my dog. I was forced to file for SS retirement just so I could start paying rent. Now living on about a third of what I made driving for Uber.

Below is a stopwatch from the day of the accident that VIA has done nothing to make this right, nothing to bring me back whole.

Mediation Failed

With $116,000. in medical alone, not to mention my totaled car, credit ruined, my lost wages, my pain and suffering, & lawyer fees. The Mediation process ended with me and my lawyer rejecting VIA’s offer, and prepared to go to court.

Why would I reject their offer when for me to begin to recover, I needed to put this behind me and focus on the obstacles ahead? Their offer added insult to injury. It was ridiculous.

Surely they saw the evidence on my dashcam video.

VIA METROPOLITAN TRANSIT offered $5,000. to settle. That should upset everyone that lives where VIA runs transportation, because it could happen to you or someone you know and or love. This was just the beginning of their insurance fraud of being “Self-Insured” using tactics like this to further cause injury… denying me the treatment and therapy I needed so desperately avoiding the responsibility of being at fault and helping me get back whole.

My Deposition

800 days after the accident, finally we get to my deposition. There was the VIA employee and the VIA lawyer, my two lawyers meeting at my Law Firm’s office in there conference room.

At one point they asked me questions that had nothing to do with the accident. Past IRS debt, past Child Support etc… It became clear there plan was to destroy my character in court, instead of taking responsibility for rear-ending me and the damage they caused.

One point it was so humiliating I spoke up and said something to the affect of “I’m not looking to make millions, I just want to be back whole.” They rolled their eyes and smirked, heartless & stone cold.

The VIA employee & their Lawyer acted so childish, passing notes back and forth, smirking like it was a big game. This is my life.

Then after badgering me over what was obvious in my dashcam video, and my persistant reply “It’s all on my dashcam video” They looked at each other and said to me “What dashcam video?” My law firm supplied the video immediately after the accident. What is the important of their question? THINK ABOUT IT…

THEY DENIED AND DELAYED MY CLAIM WITHOUT EVEN LOOKING AT THE EVIDENCE!!!
